REQUIRED STATEMENT FOR REHEARING EN BANC
I express a belief, based on a reasoned and studied professional
judgment, that this case involves one or more of the following
questions of exceptional importance:
- Whether a decision of a panel of this Court that initiated
this proceeding sua sponte and then retained jurisdiction
while assigning fact finding to a Special Master should be
the final decision of the Sixth Circuit without any form of
appellate review.
- Whether the panel validly vacated an order permitting an
international extradition to go forth in an historic case
on the ground that government attorneys committed a "fraud
on the court" by their good-faith reckless disregard of certain
relevant documents during discovery.
